Reasons and legal basis for the processing

We collect and process the personal data on the basis of 6 para. 1 b) GDPR for the:
- Execution of pre-contractual measures, which includes
  - Creation and delivery of quotations
  - All activities that are necessary to create a quotation (including, if necessary, the project registration with the product manufacturer/vendor, etc.)
- Fulfilment of contracts, which includes amongst others
  - Performing of contractual services
  - Delivery of goods
  - Performing of services (support, installation, etc.)
  - Payment and invoice processing
  - RMA processing
If your consent is given, we will collect and process the data on the basis of Art. 6 para. 1 a) GDPR for the:
- Mailing of product information, events or activities in form of an email newsletter by our marketing department
We also process data on the basis of Art. 6 para. 1 f) GDPR, if it is necessary for the purpose of legitimate interests pursued by us, amongst others to:
- Improve the support of customer- and supplier contacts
- Improve the business management
- Development and optimization of products and services
The data is additionally processed on the basis of Art. 6 para. 1 c) GDPR if this is necessary to comply with a legal requirement, which the controller has to be compliant to.

Recipients or categories of recipients of the personal data

Your personal data will be forwarded to and processed by the following company internal departments, in order to fulfil the above mentioned reasons:
- Order Processing
- Accounting
- Sales
- Procurement
- Support
- Marketing (where applicable)
If necessary, the personal data will be transferred to third parties, if this is required, in order to fulfil contractual components or to execute pre-contractual measures:
- Logistics companies and forwarders:
  - To ensure the correct delivery of ordered goods and postally shipped invoices and documents, if a person has been named as recipient
- Product manufacturers/vendors and external service providers:
  - To fulfil contracts or provide contractually arranged services (e.g. support or licenses), if a direct contact person has to be named
If you are based in Great Britain, the personal data that you provided will be transferred to STORDIS Limited, which is based in Great Britain. This is done in order to:
- Support you locally
- Process your requests locally and faster

Transfer of personal data to third countries

A transfer of your personal data to a third country will only occur, if it is required to fulfil a contract or execute pre-contractual measures.

This is only the case, if the recipient of the data (e.g. product manufacturers/vendors, service providers, etc.) are based in a third country.

The transfer is done on the basis of Art. 49 para. 1 b) and c) GDPR.

In all other cases the personal data remain within the EU and are not transferred to third countries.

Retention period of personal data

If there is a legal retention period that applies to your data, for example as required by the German Commercial Code (Handelsgesetzbuch (HGB)) or the German Fiscal Code (Abgabenordnung (AO), we will store the data for as long as we are legally required.

If there is no legal retention period that applies to your personal data, we will store the data for the duration of our business relation or until you make use of your right to object.

The data is routinely deleted upon expiry of said periods.

Individual rights

As individual you are entitled to the following rights:

You have the right to access to your personal data (Art. 15 GDPR).
If we have processed incorrect data, you have a right to rectification (Art. 16 GDPR).
If the legal requirements are given, you can request the erasure or the restriction of processing of your date (Art. 17, 18 GDPR).
You have the right to data portability (Art. 20 GDPR).
You have the right to object the processing of data (Art. 21 GDPR).
Additionally, you have the right to lodge a complaint with a supervisory authority (Art. 77 GDPR).
If you have given us your consent in accordance to Art. 6 para. 1 a) GDPR, you have the right to withdraw your consent at any time for the future (Art. 7 Abs. 3 GDPR). The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.

Zwecke und Rechtsgrundlagen der Verarbeitung

Ihre Daten werden auf Grundlage von Art. 6 Abs. 1 b) DS-GVO erhoben und verarbeitet, zur:
- Durchführung vorvertraglicher Maßnahme, das umfasst u.a.
  - Erstellen und Zusenden von Angeboten
  - Alle Tätigkeiten, die für die Angebotserstellung benötigt werden (ggf. Projektregistrierung beim Produkt-Hersteller, usw.)
- Erfüllung von Verträgen, das umfasst u.a.
  - Erfüllung von Vertragsleistungen
  - Lieferung von Waren
  - Durchführung von vereinbarten Dienstleistungen (Support, Installation, usw.)
  - Zahlungs- und Rechnungsabwicklung
  - RMA-Abwicklung
Falls Ihre Einwilligung vorliegt werden Ihre Daten auf Grundlage von Art. 6 Abs. 1 a) DS-GVO erhoben und verarbeitet, zur:
- Zusendung von Produktinformationen, Veranstaltungen und Aktionen in Form eines E-Mail-Newsletters durch unsere Marketing-Abteilung
Wir verarbeiten die Daten ebenfalls auf Grundlage von Art. 6 Abs. 1 f) DS-GVO, wenn dies zur Wahrung unserer berechtigten Interessen notwendig ist, bspw. zur:
- Verbesserung der Betreuung von Kunden- und Lieferanten
- Geschäftssteuerung
- Weiterentwicklung und Optimierung von Produkten oder Dienstleistungen
- u.a.
Weiterhin werden auf Grundlage von Art. 6 Abs. 1 c) DS-GVO Daten verarbeitet, wenn dies zur Erfüllung einer rechtlichen Verpflichtung erforderlich ist, die der Verantwortliche unterliegt.

Empfänger oder Kategorien von Empfängern der personenbezogenen Daten

Ihre personenbezogenen Daten werden zur Erfüllung der oben genannten Zwecke unternehmensintern weitergegeben an und verarbeitet durch folgende Abteilungen:
- Auftragsabwicklung
- Buchhaltung
- Vertrieb
- Einkauf

- Marketing
Gegebenenfalls werden die personenbezogenen Daten an Dritte weitergegeben, falls dies zur Erfüllung von Vertragsbestandteilen oder für vorvertragliche Maßnahmen notwendig ist:
- Logistik- und Transportunternehmen:
  - Zur korrekten Auslieferung von bestellten Waren und postalisch versandten Rechnungen und Dokumenten, falls eine bestimmte Person als Empfänger angegeben wurde
- Produkthersteller und externe Dienstleister:
  - Zur Erfüllung von Verträgen oder Bereitstellung von vertraglich vereinbarten Dienstleistungen (bspw. Support oder Lizenzen), falls ein direkter Ansprechpartner benannt werden muss
Falls Sie Ihren Sitz im britischen Raum haben, werden Ihre uns zur Verfügung gestellten personenbezogenen Daten an die STORDIS Limited mit Sitz in Großbritannien weitergegeben. Dies geschieht, um:
- Sie lokal besser betreuen zu können
- Ihre Anfragen lokal schneller bearbeiten zu können

Übermittlung von personenbezogenen Daten an ein Drittland

Eine Übermittlung von personenbezogenen Daten an ein Drittland erfolgt nur, falls dies zur Erfüllung eines Vertrages oder Durchführung vorvertraglicher Maßnahmen notwendig ist.

Dies ist dann der Fall, falls der entsprechende Empfänger (bspw. Produkthersteller, Dienstleister, etc.) seinen Sitz in einem Drittland hat.

Die Übermittlung geschieht ausschließlich auf Grundlage von Art. 49 Abs. 1 b) und c) DS-GVO.

In allen anderen Fällen verbleiben Ihre Daten innerhalb der EU und werden nicht an ein Drittland übermittelt.

Dauer der Speicherung der personenbezogenen Daten

Sind Ihre Daten gesetzlichen Aufbewahrungsfristen unterlegen, die sich insbesondere aus dem Handelsgesetzbuch (HGB) oder der Abgabenordnung (AO) ergeben, werden die Daten entsprechend der gesetzlichen Anforderungen gespeichert.

Sind die Daten keiner gesetzlichen Aufbewahrungsfrist unterlegen, werden diese für die Dauer der Geschäftsbeziehung zu Ihnen aufbewahrt oder bis Sie von Ihrem Widerrufs- oder Widerspruchsrecht Gebrauch machen.

Nach Ablauf der jeweiligen Frist werden die entsprechenden Daten routinemäßig gelöscht.

Betroffenenrechte

Als Betroffener stehen Ihnen folgende Rechte zu:

Sie haben das Recht auf Auskunft über die zu Ihrer Person gespeicherten Daten zu erhalten (Art. 15 DS-GVO).
Sollten unrichtige personenbezogene Daten verarbeitet werden, steht Ihnen ein Recht auf Berichtigung zu (Art. 16 DS-GVO).
Liegen die gesetzlichen Voraussetzungen vor, können Sie die Löschung der Daten oder die Einschränkung der Verarbeitung verlangen (Art. 17 und 18 DS-GVO).
Sie haben ein Recht auf Datenübertragbarkeit zu (Art. 20 DS-GVO).
Sie können Widerspruch gegen die Verarbeitung einlegen (Art. 21 DS-GVO).
Weiterhin haben Sie das Recht sich bei einer Aufsichtsbehörde zu beschweren (Art. 77 DS GVO).
Falls Sie uns Ihre Einwilligung nach Art. 6 Abs. 1 a) DS-GVO erteilt haben, haben Sie das Recht diese jederzeit für die Zukunft zu widerrufen (Art. 7 Abs. 3 DS-GVO). Die Rechtmäßigkeit der aufgrund der Einwilligung bis zum Widerruf erfolgten Datenverarbeitung wird durch diesen nicht berührt.
